Our site links to a limited number of other websites. Novick for Portland is not responsible for the content or the privacy policies of these websites. How do we protect your information?

Our website has a number of security measures in place to protect against the loss, misuse or alteration of the information under our control. Computer systems have restricted access limited only to those persons and organizations necessary to its proper functioning. This access applies to all electronic and physical security measures. Highly sensitive data including credit card information is additionally secured through the use of encryption, such as the Secure Socket Layer (SSL) protocol. Our servers are located in a locked, secure environment.

Automatically Collected Information

When you access or use our Site, we automatically collect information about you, including:

  • Log and Usage Information:  We collect information related to your access to and use of the Site, including the type of browser you use, app version, access times, pages viewed, your IP address, and the page you visited before navigating to our Site.

We also collect information from your device that you authorize us to collect, such as your contacts for purposes of providing you functionality that allows you to share messages with your contacts.   • Location Information:  We may derive the approximate location of your device, such as from your IP address.

We and our service providers may also obtain information about you from other sources and combine that with information we collect about you on our Site.  For example, we may collect voter file data from state and county parties and other democratic organizations, from public databases and public sources and from private organizations. We may also receive information from a social media site if you connect to us or our Site through that site.

  • To solicit volunteers, donations and support for Novick for Portland  and for other candidates, issues and organizations that we support and to connect you with other volunteers;

  • Contact you if election laws require us to request additional information from you;

  • Remind you to vote and register to vote and assist you in finding your registration information, polling location and campaign events near you;

  • Monitor and analyze trends, usage, and activities in connection with our Site;

  • Personalize and improve the Site and provide advertisements, content or features based on your user preferences, interests, and browsing and online activities;

  • Detect, investigate, prevent, and respond to fraudulent transactions, abuse, security issues, and other illegal activities and protect the rights and property of Novick for Portland, users of our sites, and others, including by enforcing our Terms & Conditions; and

  • Carry out any other purpose described to you at the time the information was collected.

How do we share your information?

We may share information about you as follows or as otherwise described in this Privacy Policy:

  • With other participants in a joint fundraising committee;

  • To report required information to the FEC, including name and mailing address of individuals whose contributions exceed $25 in an election cycle (for additional information, visit the FEC website at https://www.fec.gov;

  • In response to a request for information if we believe disclosure is in accordance with, or required by, any applicable law or legal process, including lawful requests by public authorities to meet national security or law enforcement requirements; When we believe in good faith that we are lawfully authorized or required to do so or that doing so is reasonably necessary or appropriate to comply with the law or legal processes or respond to lawful requests, claims or legal authorities, including responding to lawful subpoenas, warrants, or court orders;

  • When we believe in good faith that disclosure is necessary to protect or defend our rights, protect the safety and security of Novick for Portland, users of our Site or others, or to investigate suspected fraud, abuse, security issues, and other illegal activities;

  • If we believe your actions are inconsistent with the spirit or language of our user agreements or policies, or to protect the rights, property, and safety of Novick for Portland, its employees, volunteers, constituents, or others;

When you contribute money online:

We are required by law to collect and report to the FEC the name and mailing address of individuals whose contributions exceed $25 in an election cycle. These records are available to the public. However, they cannot be used by other organizations for fundraising. For additional information, visit the FEC website. We also make a note of your telephone number and email address, which helps us to contact you quickly if follow-up on your contribution is necessary under election law.

When you sign one of our petitions:

We may raise contributions through third party websites, and Novick for Portland  may pay a fee for the use of such websites. We may share your information with the hosts of those websites. Novick for Portland  is not responsible for the activities conducted by such websites. Novick for Portland  is not liable to you for your use of or for the security of your information by such websites, and you should consult the privacy policy and terms of service of those websites for further information.

We treat your name, city, state, and any comments as public information. We may, for example, provide compilations of petitions, with your comments, to national leaders, without disclosing email addresses. We may also make comments along with your city and state available to the press and public online.

Using social media to communicate with supporters

Novick for Portland  may use third party social media platforms, e.g., Facebook messenger and the like, to communicate with supporters and such use will be consistent with the privacy requirements of those platforms. The Site may offer social sharing features and other integrated tools (such as the Facebook “Like” button), which let you share actions you take on our Site with other media, and vice versa. Advertising and analytics provided by others

We may place online advertising with third-party vendors, including Google, which will be shown on other Sites on the Internet. In some cases, those third-party vendors may decide which ads to show you based on your prior visits to the Site. At no time will you be personally identified to those third-party vendors, nor will any of the information you share with us be shared with those third-party vendors.

When you schedule online events:

When you schedule an event and choose to post it on www.novickforportland.com you have the choice of making your event public or semi-public. Public events will display your name and the address of the event to any visitor browsing the system and allow those users to RSVP. Semi-public events will display your name and the general area that you define (e.g.”1st & Main”, or “downtown”), but will not display the specific address. Visitors can requests invitations, and only after those requests are approved by you can they see the address.

Links to other websites and third parties

The Sites may make third-party information, advertisements, promotions and other content available on or through the Sites (“Third Party Content”). Our Sites also may link or otherwise provide access to third-party websites and other products and services outside our control (collectively, “Third-Party Products and Services”). These Third-Party Products and Services may include, for example, event and volunteer registration and management, donation and payment functionality, and other features, functionalities, and services powered by third parties. These Third-Party Products and Services and Third-Party Content are not under the control of Novick for Portland , and Novick for Portland  is not responsible for the security or privacy of any personal information you share with them. If you use Third-Party Products and Services, those third parties’ collection, use and disclosure of your information will not be subject to this Privacy Policy; rather, it will be subject to their own privacy policies and terms. What are your choices?

Cookies

Transfer of Information to the United States:

Novick for Portland  is based in the United States, and is directed to U.S. residents, and we process and store information in the U.S. If you are located outside the U.S., we and our service providers may transfer your information to, or store or access to your information in, jurisdictions that may not provide equivalent levels of data protection as your home jurisdiction. 

IP Addresses and Log File Data:

We log IP address, which is the location of your computer or network on the Internet, for systems administration and troubleshooting purposes. We also use page hits in the aggregate to track the popularity of pages that people visit in order to improve the quality of the site. There is no personal identifiable information collected in our log files.

Your California Privacy Rights

Information on Children:

Because we care about the safety and privacy of children online, we comply with the Children’s Online Privacy Protection Act of 1998 (COPPA). COPPA and its accompanying FTC regulations establish United States federal law that protects the privacy of children using the Internet. We do not knowingly contact or collect personal information from children under 13. Our site is not intended to solicit information of any kind from children under 13, and we have designed our sites to block our knowing acceptance of information from children under 13 whenever age-related information is requested.

All other trademarks, registered trademarks, product names and campaign names or logos mentioned on the Site are the property of their respective owners. Reference to any products, services, processes or other information by trade name, trademark, manufacturer, supplier or otherwise does not constitute or imply endorsement, sponsorship or recommendation by us. You may not use a Novick for Portland logo or any other proprietary graphic of Novick for Portland to link to these Site without express written permission of Novick for Portland . Further, you may not use, frame or utilize framing techniques to enclose any Novick for Portland trademark, logo or other proprietary information, including the images found at the Site, the content of any text or layout/design of any page or form contained on a page on the Site without Novick for Portland express written consent. To the extent you have any rights, title, or interest in any of the foregoing, you shall assign, and hereby assign, any and all such rights, title, and interest to Novick for Portland . 

9. Repeat Infringer Policy; Copyright Complaints

In accordance with the Digital Millennium Copyright Act and other applicable law, we have adopted a policy of terminating or limiting the access of, in appropriate circumstances, the accounts of users who repeatedly infringe the intellectual property rights of others at our sole discretion. 11. Indemnification

To the fullest extent permitted by applicable law, you will indemnify, defend and hold harmless Novick for Portland and its independent contractors, service providers, and consultants, successor organizations, and joint committee members, and each of their respective officers, directors, agents, partners and employees (individually and collectively, the “Indemnified Parties”) from and against any losses, liabilities, claims, demands, damages, expenses or costs (“Claims”) arising out of or related to (a) your User Content or Feedback; (b) your violation of these Terms; (c) your violation, misappropriation or infringement of any rights of another (including intellectual property rights or privacy rights); or (d) your misconduct in connection with the Site. You agree to promptly notify Indemnified Parties of any third-party Claims, cooperate with Indemnified Parties in defending such Claims and pay all fees, costs and expenses associated with defending such Claims (including, but not limited to, attorneys' fees). To the fullest extent permitted by applicable law, Novick for Portland and its contractors, service providers, consultants, successor organizations, and joint committee members, and each of their respective officers, directors, agents, and employees (collectively, the Novick for Portland Parties”),  will not be liable to you under any theory of liability—whether based in contract, tort, negligence, strict liability, warranty, or otherwise—for any indirect, consequential, exemplary, incidental, punitive or special damages or lost profits, even if such parties have been advised of the possibility of such damages. These include but are not limited to damages caused by reliance by user on any information obtained from Novick for Portland , or that result from mistakes, omissions, interruptions, deletion of files or email, errors, defects, viruses, delays in operation or transmission or any failure of performance, whether or not resulting from acts of God, communications failure, theft, destruction or unauthorized access to Novick for Portland records, programs or services, even if one or more of them has been advised of such damages or loss. The total liability of Novick for Portland and the other Novick for Portland Parties for any claim arising out of or relating to these Terms or our Site, regardless of the form of the action, is limited to $5.00.

14. Governing Law and Venue

Any dispute arising from these Terms and your use of the Site will be governed by and construed and enforced in accordance with the laws of the District of Columbia, except to the extent preempted by U.S. federal law, without regard to conflict of law rules or principles (whether of the District of Columbia or any other jurisdiction) that would cause the application of the laws of any other jurisdiction. Any dispute between the parties will be resolved in the state or federal courts of the District of Columbia and the United States.
